Copyright, Piracy and Goverments trying to write your rights away

What do you see are the biggest issues/problems with Digital Copyright today?

Whilst copyright is a good idea, its generally abused far too often, or badly implemented to the point where it becomes more of a hassle than its worth.
Right now copyright is a massive problem on YouTube where content creators will have their content ripped in their entirety and posted on websites like Facebook

Or even worse, people who abuse the copyright system in YouTube to issue false copyright strikes, even if they have no right to the content or flat out dont understand fair use at all. [looking at you nintendo/studio ghibli] and just go NO, THAT’S MINE. YOU GET BANNED.
To the point where often content creators wont even touch their content at all.

And the idea of companies constantly re-upping their copyrights to prevent derivative content ever being made, like Mikey Mouse should be public domain by now but Disney are flat out not allowing it and i doubt ever will.

What is/are your solution(s) to these?

For the first issue, websites like Facebook need to be more vigilant with content thieves, look at the situation that went down surrounding a very popular facebook page called SoFloAntonio where he would just rip somebodies content, put a 3second clip of him talking at the start and then post it. Facebook needs to proactivly ban these kind of people and prevent them from ever posting pages again if they are commonly doing this kind of content theft.

Google needs to put a whole load more money and time into protecting their content creators, cause if YouTube keeps up like this the big creators will just leave for another website and YouTube will die.

This is a difficult problem, whilst i copyright owners should have the rights to profit from their things, at what point can something be considered vital to the cultural zeitgeist and should be allowed to be used by everybody. like Studio Ghiblis films are some of the best Anime films ever made, but its nigh impossible to make derivative work of it because the studio itself will just shut you down.

I think there needs to be hard limits on how long a copyright can be and this limit cannot be extended. Make it fair like 30 years or something.

What is your opinion of the current NZ and overseas legislation attempting to protect the owner of the work?

TPP and the like are very insidious bills made by people who generally have no idea what they are talking about. The core issue is the concept of piggybacking where i can create a bill about one thing, and somebody pays/bribes me to stick another totally unrelated bill in hoping it just gets rubber-stamped alongside the primary bill. TPP and its other related bills are exactly this. Trade is a good thing, but not when it also impacts and heavily damages the rights of the citizens.

Include two examples of Fair Dealing that you have come across. Comment on why you see this as Fair Use and not just copyright infringement.

My favorite Genre of music is called Vaporwave, and is entirely built upon the concepts of Sampling

Without the freedom provided by fair use, the entire genre wouldn’t exist.

Another is channels that take videogames, movies and whatnot and edit them to become their own individual work. think like JonTron, any Lets play channel etc.

These people don’t own the content, yet because of fair use have the right to modify and make their own thing out of it.

In conclusion, Copyright is a good concept at its core, but written on laws that are vastly outdatedĀ  and don’t mesh with the current entertainment zeitgiest

oh and TPP can go jump in a lake.
